Starting a trucking business comes with many challenges, and compliance with federal regulations is at the top of the list. The Federal Motor Carrier Safety Administration (FMCSA) closely monitors all new motor carriers through the New Entrant Safety Audit, an evaluation conducted within the first 18 months of operation. This audit determines whether a carrier is meeting safety and compliance requirements, and while it only results in a pass or fail outcome, understanding the process and potential pitfalls is crucial for long-term success.
The FMCSA’s mission is to reduce accidents, injuries, and fatalities involving large trucks and buses. To ensure new carriers operate safely, the agency requires them to undergo a safety audit that verifies their adherence to regulatory standards. This can take place either in person at the carrier’s place of business or electronically, where carriers submit necessary documentation online, by mail, or by fax.
A pass means the carrier’s safety performance will continue to be monitored for the remainder of the 18-month new entrant period. If no further safety violations occur, the carrier is granted permanent operating authority. A fail, on the other hand, comes with serious consequences. FMCSA provides written documentation of violations, requiring the carrier to submit a Corrective Action Plan (CAP) within a specified timeframe. Failing to submit or implement corrective actions can result in FMCSA registration loss, effectively shutting down operations.
There are 16 key violations that can cause a carrier to fail the audit. These range from failing to implement a drug and alcohol testing program to not maintaining driver qualification files. While the audit process is straightforward, many new carriers struggle with compliance simply because they are unaware of what is required.
